1. Acceptance of Terms
These Terms of Service form a binding agreement between you and GiftPilot, governing your use of our iOS app and website at giftpilotapp.com (the “Service”). By creating an account, downloading, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
2. Account Requirements
You must be at least 13 years old (or the minimum age in your country) to use GiftPilot. You are responsible for keeping your login credentials secure and for all activity under your account. Report any suspected unauthorized access to support@giftpilotapp.com immediately.
3. Acceptable Use
You agree not to:
- Use the Service for illegal or harmful purposes
- Upload content that violates the privacy of minors or others
- Attempt to scrape, reverse-engineer, or decompile the Service
- Resell or commercially exploit the Service
- Generate hateful, sexual, or otherwise prohibited content
4. Subscriptions & Billing
GiftPilot Pro is available on two plans:
- Monthly: $2.99 per month (auto-renews monthly)
- Annual: $19.99 per year — includes a 7-day free trial (best value)
Prices are shown in USD; local currency rates may vary based on Apple's regional pricing. We will provide advance notice of any future pricing changes. Auto-renewal occurs unless you cancel at least 24 hours before the renewal date.

5. Free Trial Terms
The 7-day free trial applies only to first-time annual plan subscribers. If you do not cancel before the trial period expires, you will be charged $19.99 (or the local equivalent). Cancelling during the trial prevents any charge.
6. Refund Policy
All refund requests are handled by Apple, not GiftPilot. To request a refund, visit reportaproblem.apple.com. Users in the EU/EEA or UK have statutory withdrawal rights; contact support@giftpilotapp.com for assistance.
7. AI-Generated Content
GiftPilot uses AI to suggest gifts based on your input. These suggestions are recommendations only — not guarantees of product quality, availability, pricing, or suitability. Product details change constantly; always verify before purchasing. GiftPilot does not sell products, is not responsible for third-party merchants, and does not guarantee external links. You are responsible for the accuracy of the prompts and recipient details you enter.
8. Intellectual Property
GiftPilot owns the app name, logo, design, and Service, all protected by applicable intellectual property law. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms and Apple's standard EULA.
You retain ownership of all content you input (people, gift ideas, lists). By using the Service, you grant GiftPilot a limited licence to host, process, and display that content solely to provide the Service to you.
9. Disclaimers
The Service is provided “as is” and “as available” without any warranties, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement. GiftPilot does not warrant uninterrupted service, error-free operation, or the accuracy of AI suggestions.
10. Limitation of Liability
To the fullest extent permitted by law, GiftPilot will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or intangibles. Our total liability to you will not exceed the greater of (a) the amounts you paid in the 12 months preceding the claim, or (b) US$50. Some jurisdictions do not permit these limitations.
11. Termination
You may stop using the Service and delete your account at any time from within the app. GiftPilot may suspend or terminate access for material violations of these Terms or for harmful use. Sections covering intellectual property, disclaimers, liability, and governing law survive termination.
12. Apple App Store Terms
These Terms are between you and GiftPilot, not Apple. Apple is not responsible for maintenance or support. In the event of a conflict, Apple's Licensed Application End User Licence Agreement controls. Apple is a third-party beneficiary of these Terms with the right to enforce them.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Disputes will be resolved in Delaware state or federal courts, except where consumer-protection law in your jurisdiction permits local proceedings.
14. Changes to Terms
We may update these Terms periodically. Material changes will be communicated via in-app notification or email, and the “Last updated” date will be revised. Continued use after changes take effect constitutes acceptance.
